Who we are and scope of these terms<\/strong><\/p>\n<p>These General Terms and Conditions of Sale (the Terms) govern the distance sale of Nordest Cycles products through https:\/\/www.nordestcycles.com (the Website). The seller is:<\/p>\n<ul>\n<li>Company name: Jer\u00f3nimo Cycles, S.L., sole-shareholder company (sociedad unipersonal) (trade name: Nordest Cycles)<\/li>\n<li>Tax ID (CIF): B76540327<\/li>\n<li>Registered office: C\/ Hermosilla 48, 1\u00ba Dcha, 28001 Madrid, Spain<\/li>\n<li>Email: info@nordestcycles.com<\/li>\n<li>Telephone: +34 644 379 574<\/li>\n<li>Registered in the Commercial Registry of Madrid, volume 38471, folio 48, section 8, sheet M-684286<\/li>\n<\/ul>\n<p>Please read these Terms before placing your order. By placing it, you tick the box &#8220;I have read and accept the Terms and Conditions of Sale&#8221; and a contract is formed between you and us. The Terms are always available on the Website for you to save or print, and we send them to you with your order confirmation. They are supplemented by the <a href=\"https:\/\/nordestcycles.com\/en\/terminos-y-condiciones\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Legal Notice<\/a> and the <a href=\"https:\/\/nordestcycles.com\/en\/politica-de-privacidad-y-de-cookies\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Privacy and Cookies Policy<\/a>.<\/p>\n<p>The contract may be concluded in Spanish or English. In case of discrepancy between versions, the Spanish one prevails, without prejudice to the protection that the law grants you as a consumer.<\/p>\n<p>Neither party may assign the contract to a third party without the other&#8217;s consent. We may assign it to another company in our group or to our successor in the business, provided your guarantees are not reduced.<\/p>\n<p><strong>2. Who can buy<\/strong><\/p>\n<p>To buy you must be at least 18 years old, or legally emancipated, and have sufficient legal capacity to contract. The rights of withdrawal and statutory consumer guarantee in these Terms belong to consumers, that is, people who buy for purposes outside their trade or profession. If you buy as a professional (for example, a workshop or a shop), the other conditions and the general rules on the sale of goods apply.<\/p>\n<p><strong>3. How to place an order<\/strong><\/p>\n<ol>\n<li>Choose the product and its options and add it to the cart.<\/li>\n<li>Enter your details and the delivery address.<\/li>\n<li>Choose the shipping method and the payment method.<\/li>\n<li>Review the order summary (products, total price including taxes, shipping costs and delivery time) and correct any mistakes.<\/li>\n<li>Tick the acceptance box and click &#8220;Order with obligation to pay&#8221;.<\/li>\n<\/ol>\n<p>You will receive a confirmation email with the order summary, these Terms and the model withdrawal form. If you do not receive it within 24 hours, write to us at info@nordestcycles.com. We file the contract and you can ask us for a copy.<\/p>\n<p>You agree to receive electronic invoices in PDF format at the email address you provide when ordering. You can withdraw this consent at any time by writing to info@nordestcycles.com.<\/p>\n<p><strong>4. Products and availability<\/strong><\/p>\n<p>Each product page describes its main features. That information, the images and the descriptions form part of the contract. If a product is not available when you place your order, we will tell you immediately and will not charge you for it.<\/p>\n<p>Made-to-measure or personalised products: some frames are made to the measurements or specifications you choose. Each product page says which ones. We start making them when we confirm payment and measurements, they cannot be withdrawn from (section 9.2) and the estimated delivery time appears on the product page and in the confirmation. Check the measurements before confirming your order.<\/p>\n<p><strong>5. Prices and taxes<\/strong><\/p>\n<p>The prices on the Website include the taxes that apply in each case, with the breakdown required by law. Shipments to destinations outside the EU VAT territory, such as the Canary Islands or countries outside the Union, are invoiced without Spanish VAT; taxes, duties and customs charges in the destination country are for your account (section 8.5).<\/p>\n<p>The price in force when you place the order applies. When we announce a sale, we will show the previous price, which will be the lowest we applied in the previous 30 days, and the reduction will be calculated on it.<\/p>\n<p><strong>6. Payment methods<\/strong><\/p>\n<ul>\n<li><strong>Credit or debit card<\/strong> (Visa, Mastercard and Maestro) through the secure Redsys payment gateway (we do not store your full card details).<\/li>\n<li><strong>Bank transfer.<\/strong> After placing the order we will give you the IBAN and the reference (your order number). Verification can take up to three working days and we ship the order once it is confirmed.<\/li>\n<\/ul>\n<p>We do not accept cheques, promissory notes, cash, cash on delivery, direct debits or PayPal. If you have any problem with your order, write to us before asking your bank to reverse the charge and we will do our best to solve it.<\/p>\n<p><strong>7. Delivery<\/strong><\/p>\n<p>We will deliver your order to the address you indicate within no more than 15 working days from order confirmation, unless the product page or the confirmation states a different time (for example, for pre-orders or made-to-measure products) or you choose express shipping: 2 working days in Spain and 4 working days in Europe. If we do not agree on another date, the legal maximum is 30 calendar days from the conclusion of the contract.<\/p>\n<p>If we do not deliver on time, you can give us an additional reasonable period and, if we still fail to deliver, terminate the contract and recover what you have paid.<\/p>\n<p>If after your order the product is not available, we will tell you and refund what you paid without undue delay and, at most, within 14 days. We may also offer you, at no extra cost, a similar product of equal or higher quality; in that case you keep your withdrawal and termination rights as if it were the original product.<\/p>\n<p>The risk of loss or damage to the product passes to you when you, or a person you designate (other than the carrier), receive it. We recommend that you check the parcel on receipt and tell us immediately if it is damaged.<\/p>\n<p><strong>8. Shipping<\/strong><\/p>\n<p><strong>8.1. Geographical scope.<\/strong> We sell to any country, except those listed at any given time on the European Union consolidated list of financial sanctions. Before buying, check whether your country appears on it on the official EU website. If you have any doubts, write to us at info@nordestcycles.com.<\/p>\n<p><strong>8.2. Shipping cost.<\/strong> The shipping cost of each product is shown on the Website, before you confirm the order, and already includes any applicable taxes. Multiple orders.<\/strong> If you place several orders, what the Website states when you buy applies and, in general:<\/p>\n<ul>\n<li>shipping costs are charged separately for each order when the products are frames, kits or complete bicycles;<\/li>\n<li>shipping is single if the order includes a frame or a kit together with a T-shirt or a spare part, and the higher shipping charge applies, unless shipping is free;<\/li>\n<li>if you buy several T-shirts or spare parts with the same address, we group them in a single parcel and you pay one shipping charge.<\/li>\n<\/ul>\n<p><strong>8.4. Carriers and restrictions.<\/strong> We currently ship with Seur or Correos Express within Spain and with DPD Group or DHL Express to the rest of the world. We may change carriers at any time. Today we do not apply shipping restrictions based on weight or size, although we may change this in the future.<\/p>\n<p><strong>8.5. Customs and destination taxes.<\/strong> The price does not include duties, import taxes or customs charges in the destination country. You pay them, if any, according to their customs regime. Please check them before you buy.<\/p>\n<p><strong>8.6. Tracking.<\/strong> If you want the tracking number of your order, ask for it at info@nordestcycles.com and we will send it to you.<\/p>\n<p><strong>8.7. Order not delivered.<\/strong> If we cannot deliver your order for a reason attributable to you (incorrect address, failed delivery attempts, not collected) and it returns to us, we will refund the price of the product, less the shipping costs we paid. If the reason is not attributable to you, we will refund everything, including shipping, or send it again, as you prefer. If you want a product that could not be delivered, place a new order.<\/p>\n<p><strong>8.8. Damaged, defective or incorrect product.<\/strong> See sections 10 and 11.<\/p>\n<p><strong>9. Right of withdrawal (consumers only)<\/strong><\/p>\n<p><strong>9.1. Period.<\/strong> You may withdraw from the contract without giving any reason within 14 calendar days from the day you, or a third party you have indicated who is not the carrier, receive the products. If you order several products in the same order and they are delivered separately, the period runs from when you receive the last one.<\/p>\n<p><strong>9.2. Exceptions.<\/strong> In accordance with Royal Legislative Decree 1\/2007 (General Law for the Defence of Consumers and Users), you cannot withdraw, among other cases, from:<\/p>\n<ul>\n<li>products made to your specifications or clearly personalised, such as made-to-measure frames;<\/li>\n<li>products that, after delivery, have become inseparably mixed with other items;<\/li>\n<li>sealed products that cannot be returned for health or hygiene reasons and that you have unsealed.<\/li>\n<\/ul>\n<p><strong>9.3. How to withdraw.<\/strong> Before the period ends, tell us your decision in any of these ways:<\/p>\n<ul>\n<li>the &#8220;Withdraw from the contract here&#8221; function on the Website;<\/li>\n<li>an email to info@nordestcycles.com with a clear statement that you withdraw, your name and the order number;<\/li>\n<li>the <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2007-20555\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">model withdrawal form<\/a> or the one at the end of these terms.<\/li>\n<\/ul>\n<p>We will confirm by email that we have received your notice.<\/p>\n<p><strong>9.4. Returning the products.<\/strong> Return the products to us without undue delay and, at most, within 14 calendar days from when you tell us you are withdrawing, following the instructions we will give you. The direct costs of the return are for your account. You are only liable for any reduction in the value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. We recommend returning them protected, in their original packaging and with the documentation, but that is not a requirement to withdraw.<\/p>\n<p><strong>9.5. Refund.<\/strong> We will refund all the payments you have made, including standard shipping costs, without undue delay and, at most, within 14 calendar days from when we receive your notice. We do not refund the extra costs if you chose a more expensive shipping method than the standard one, such as express. We use the same payment method you used, unless we agree otherwise, and we may withhold the refund until we receive the products or until you prove you have sent them back, whichever happens first.<\/p>\n<p><strong>10. Statutory guarantee<\/strong><\/p>\n<p>We are liable for any lack of conformity that exists when we deliver the product and appears within three years of delivery. Unless proven otherwise, a lack of conformity that appears in the first two years is presumed to have existed when the product was delivered.<\/p>\n<p>A product conforms with the contract if it meets all of the following, unless in the circumstances one of them does not apply:<\/p>\n<ul>\n<li>it matches the description we have given and has the qualities we presented to you;<\/li>\n<li>it is fit for the purposes for which products of the same type are normally used;<\/li>\n<li>it offers the quality and performance that are usual for a product of the same type and that you can reasonably expect, including our public statements in advertising or labelling.<\/li>\n<\/ul>\n<p>We are not liable for any lack of conformity that you knew of or could not reasonably have been unaware of when you contracted.<\/p>\n<p>If the product does not conform, you can demand its repair or replacement, at your choice, unless it is impossible or disproportionate. Both are free and include shipping and collection costs. If that is not possible or we do not do it within a reasonable time and without significant inconvenience, you can ask for a price reduction or terminate the contract. Termination is not available if the lack of conformity is minor.<\/p>\n<p>To make a claim, write to info@nordestcycles.com with the order number, a description of the problem and, if you can, photographs.<\/p>\n<p><strong>11. Damaged, defective or incorrect products and returns<\/strong><\/p>\n<p>11.1. If you receive a product that is damaged, defective or not what you ordered, write to us at info@nordestcycles.com with the order number, the reason and photographs. We will tell you how to return it and keep you informed by email about the status of your request.<\/p>\n<p>11.2. In those cases you are entitled to the remedies of the statutory guarantee (section 10) and, if you choose to terminate the contract, to a refund of the price, the shipping costs and the return costs. We do not impose time limits shorter than the legal ones.<\/p>\n<p>11.3. Returns by withdrawal are governed by section 9.<\/p>\n<p>11.4. Outside the cases provided for by law or by these terms, we do not accept returns. We always refund using the same payment method you paid with.<\/p>\n<p>11.5. These terms do not affect the rights that the law grants you as a consumer.<\/p>\n<p><strong>12. Safety and use of the products<\/strong><\/p>\n<p>Before assembling or using any frame, kit or component, read the <a href=\"https:\/\/nordestcycles.com\/en\/manual-3\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">User manual<\/a>. We recommend that a qualified professional mechanic carry out the assembly. If you need further safety information about a product, write to us at info@nordestcycles.com.<\/p>\n<p><strong>13. Liability<\/strong><\/p>\n<p>We are not liable for losses that do not result from a breach by us, or for indirect losses that were not reasonably foreseeable by the parties when contracting. If you buy as a professional, we are also not liable for business losses, such as loss of profit, contracts, data or goodwill.<\/p>\n<p>We are not liable for delays or failures caused by circumstances beyond our reasonable control or attributable to third parties, without prejudice to your right to receive the product within a reasonable time under the law.<\/p>\n<p>Nothing above limits our liability for wilful misconduct, gross negligence or personal injury, or the non-waivable rights that the law grants you as a consumer.<\/p>\n<p><strong>14. Customer service, complaints and alternative dispute resolution<\/strong><\/p>\n<p>You can contact our customer service at info@nordestcycles.com or on +34 644 379 574. We will reply within 3 working days. To make a complaint, write to the same email address stating your details, the order number and the reason.<\/p>\n<p>Jer\u00f3nimo Cycles S.L. is not a member of any consumer alternative dispute resolution body.<\/p>\n<p>If you are a consumer, you can also go to the consumer services of your region or your country of residence.<\/p>\n<p><strong>15. Changes to the terms and severability<\/strong><\/p>\n<p>We may change these Terms, the Website and our policies at any time. The terms in force when you place the order will apply, and orders already confirmed are governed by the terms under which you placed them. We will inform you of planned changes when reasonable and technically possible.<\/p>\n<p>If any of these conditions is declared invalid, void or ineffective, it will be deemed excluded without affecting the validity of the rest. Our not requiring compliance with a condition at a given moment does not mean we waive the right to require it later.<\/p>\n<p><strong>16. Governing law and jurisdiction<\/strong><\/p>\n<p>These Terms are governed by Spanish law. If you are a consumer, you keep the rights that the law of the country where you habitually reside grants you. Before going to court, you can write to us at info@nordestcycles.com to seek an amicable solution. If you are a consumer, the court of your place of residence will have jurisdiction. In all other cases, the courts of Madrid will have jurisdiction.<\/p>\n<p><strong>17.
